These Terms of Service (“Terms”) govern your use of the SnoreGraph mobile application (the “App”), provided by Day One Foundry LLC (“we,” “us,” or “our”). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
You may use the App for your own personal, non-commercial use. If you are under the age of majority where you live, you may use the App only with the involvement of a parent or guardian.
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple devices that you own or control. You may not copy, modify, distribute, sell, lease, reverse-engineer, or attempt to extract the source code of the App, except to the extent this restriction is prohibited by applicable law.
SnoreGraph records and analyzes the sounds of your sleep to help you understand your snoring over time, test remedies, and see trends. It is a consumer wellness tool and is not a medical device. It does not diagnose, treat, cure, prevent, or monitor sleep apnea or any other medical condition, and its measurements are estimates, not clinical readings. The App is not a substitute for professional medical advice, diagnosis, or treatment. Never disregard professional advice or delay seeking it because of something you saw in the App. If you snore heavily, gasp or choke during sleep, feel excessively tired during the day, or have any concern about your breathing or sleep, please consult a qualified healthcare professional.
SnoreGraph offers an optional “Pro” upgrade as an auto-renewing subscription, offered on a monthly basis and on an annual basis, with the annual plan including an introductory free trial. Payment is charged to your Apple Account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours prior to the end of the current period. You can manage or cancel your subscription, and turn off auto-renew, in your Apple Account settings. Any unused portion of a free trial is forfeited when you purchase a subscription, where applicable. All purchases are processed and any refunds are handled by Apple in accordance with Apple’s terms; we do not process payments directly.
Recordings and data you create in the App are stored on your device and belong to you. We do not receive or store them. You are responsible for managing and, if you wish, deleting this content, which you can do at any time within the App.
You agree to use the App only for lawful purposes, and only to record audio in circumstances where you are permitted to do so. You are responsible for complying with any applicable laws regarding the recording of sound, including where other people may be present. You agree not to misuse, disrupt, or attempt to gain unauthorized access to the App or its systems.
The App is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted or error-free, that it will detect every sound accurately, or that any content or feature will achieve a specific result.
To the fullest extent permitted by law, Day One Foundry LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising from your use of or inability to use the App.
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the App after an update means you accept the revised Terms.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules.
